The General Counsel’s request for special permission to appeal Administrative
Law Judge Geoffrey Carter’s order granting Respondents Community Health Systems
Professional Services Corporation, LLC (CHSPSC) and Community Health Systems,
Inc.’s (CHSI) renewed motion for consent order and partial dismissal is denied because,

having filed the request approximately 3 months after the judge issued the order, the
General Counsel failed to comply with the promptness requirement set forth in Section
102.26 of the Board’s Rules and Regulations. This denial is without prejudice to the
General Counsel’s ability to renew his arguments on exceptions to the Board after the
judge’s decision on the merits of the case.
