I. O. Case No. R-3573 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES, April 24,1942 - On March 12, 1942, the National Labor Relations Board issued its Decision and Direction of Election in the above-entitled proceedings. Pursuant to the Direction of Election an election by secret ballot was conducted on March 27, 1942, under the direction and supervision of the Regional Director for the Seventh Region (Detroit, Michigan). On March 28, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. I O_ 23 On April 4, 1942, the Company filed Objections to the Election Report. On April 10, 1942, the Regional Director issued a Report on Objections, copies of which were duly served upon the parties, in which lie concluded that the challenged ballot could not have affected the result of the election and that there was no merit in the allegation of the Company that the Union improperly influenced the result of the election. 1 39 N L. L II B, No 149 840 DETROIT NUT COMPANY 841 The Board has considered the objections of the Company, the Elec- tion Report, and the Report on Objections, and finds that the objec- tions do not raise substantial or material issues with respect to the conduct of the ballot or the Election Report. The objections are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 949, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Local 174, United Automobile, Aircraft, & Agricultural Implement Workers of America, C. I. 0., has been designated and selected by a majority of all hourly paid production and maintenance employees at the Detroit plant of Detroit Nut Com- pany, Detroit, Michigan, including set-up men, but excluding execu- tives, foremen, office and clerical employees, and guards, as their repre- sentative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Local 174, United Automobile, Aircraft, & Agricultural Implement Workers of America, C. I. 0., is the exclusive representative of all such employees for the purpose of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
