ORDER TRANSFERRING PROCEEDING TO THE BOARD
and
NOTICE TO SHOW CAUSE
On January 17, 2017, the General Counsel filed with the National Labor Relations
Board a Motion for Summary Judgment on the ground that the Respondent’s answer
admits the factual allegations in the complaint, and that therefore the pleadings and
exhibits demonstrate that there are no issues of fact and an evidentiary hearing is
unnecessary. The Respondent did not file an opposition to the General Counsel’s motion.
Having duly considered the matter,
IT IS ORDERED that the above-entitled proceeding be transferred to and continued
before the Board in Washington, D.C., and that the hearing scheduled for February, 14,
2017 be postponed indefinitely.
NOTICE IS GIVEN that cause be shown, in writing, filed with the Board in
Washington, D.C., on or before February 27, 2017 (with affidavit of service on the parties
to this proceeding), why summary judgment should not be granted in favor of either party.
Any briefs or statements in support of the motion shall be filed by the same date.
