KAPLAN, MEMBER JOHN F. RING, MEMBER Dated, Washington, D.C., March 25, 2021. 1 We find it unnecessary to pass on the Employer’s assertion that the Acting Regional Director misstated the number of H-1B visa applications the Employer processed for UMass-Amherst graduate students in the previous year, as it does not affect the result. In addition, the Employer contends that the Acting Regional Director erred by suggesting that relevant conflicts of interest are limited to direct pecuniary conflicts. To the contrary, the Acting Regional Director correctly noted that conflicts are not necessarily so limited, but we agree, for the reasons he stated, that there is no conflict of interest here.
