Case No. R-3451 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES March 14, 1942 - On February 9, 1942, the National Labor Relations Board, herein' called the 'Board, issued its Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Elec= tion, an election by secret- ballot was conducted on February 20, 1942, under the supervision and direction of the Regional Director for the Second Region (New York City). On February 21, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties her Election Report. F. of L.___________________________________ 65 Votes cast for neither______________________________________ 5 On February 24 and 26, 1942, Wholesale Meat Distributors Union, Local 640 of the Amalgamated Meat Cutters and Butcher Workmen of North America, affiliated with the American Federation of Labor, filed its objections to the conduct of the election and to the Election Report, and requested oral argument. On March 9, 1942, the Re- gional Director issued her Report on Objections. The Board, having 138 N L R B 1009. 39 N. L. B. B., No. 155 808 CUDAHY PACKING COMPANY 809 duly considered the Election Report, the objections thereto, and the Regional Director's report thereon, finds that the objections raise no substantial and material issues with respect to the conduct of the ballot or to the Election Report. The objections are hereby overruled. The request for oral argument is denied. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Packinghouse Workers Organizing Committee, C. I. 0., has been designated and selected by a majority of all production employees of Cudahy Packing Company, Jersey City, New Jersey, including coopers, but excluding chauffeurs, weighmasters, watchmen, mechanics, roustabouts, engineers, firemen, supervisors, managerial employees, "schochtim," office janitors, office clerks, carpenters, and electricians, as their -representative for the purposes of collective bargaining and that, pursuant to the provi- sions of Section 9 (a) of the National Labor Relations Act, Pack- inghouse Workers Organizing Committee, C. I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
