Mr. Havpold Weston, of counsel to the Board. DECISION AND CERTIFICATION OF REPRESENTATIVES . On March,27 and April 2, 1941, respectively, Steel Workers Organ- izing Committee, Local Union #1026, herein called the S. W. O. C., filed with the Regional Director, for the Thirteenth Region (Chicago, Illinois) a petition and amended petition alleging that a question affecting commerce had arisen concerning the representation of em- ployees of the Continental Roll & Steel Foundry Company, herein called the Company, engaged at East Chicago, Indiana, in the design, manufacture, sale, and distribution of steel castings, various types of rolling-mill rolls and heavy machinery, and requesting an inves- tigation and certification of representatives-pursuant to Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, herein called the Act. On April 11, 1941, the- National Labor Relations- Board, herein called the Board, acting pursuant to Section 9 (c) of- the, Act and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ordered an investigation and au- thorized the Regional Director to conduct it and provide for an appro- priate hearing upon due notice. On April 23, 1941, the Company, the S. W. O. C., the American Federation of Labor, Federal Local 31 N. F. of L., and counsel for the Board entered into a "Stipulation For Certification Upon Consent Election.' Pursuant to the stipulation, an election by secret ballot was con- ducted on May 2, 1941, under the direction and supervision of the Regional Director among all production maintenance employees of the Company including watchmen and excluding superintendents, foremen, assistant foremen, employees in the main office, pattern makers and pattern makers' apprentices, to determine whether said employees desire to be represented for the purposes of collective bar- gaining'by the S. W. O. C., by the A. F. of L., or by neither. On May 3, 1941, the Regional Director issued his Election Report on the ballot, copies of which were duly served upon the parties. No objec- tions to\ the conduct of the ballot or the Election Report have been filed by any of the parties. A question affecting commerce has arisen concerning the repre- sentation of employees of Continental Roll & Steel Foundry Com- pany, East Chicago, Indiana, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act.' 2. All production and maintenance employees of the Company including watchmen, and excluding superintendents, foremen; assistant foremen, employees in the main office, pattern makers, and pattern makers' apprentices, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act. 3. The American Federation of Labor, Federal Local No. 22636, has been designated and selected by a majority of the employees in the above unit as their representative for the purposes of collective bargaining and is the exclusive representative of all the employees in said unit within the meaning of Section 9 -(a) of the National Labor Relations Act. Relations Board, by Section 9 (c) of the National Labor Relations Act, - IT IS HERESY CERTIFIED that American Federation of Labor, Federal Local No. 22636, has been designated and selected by a majority of all production and maintenance employees employed by Continental Roll & Steel Foundry Company at East Chicago, Indiana, includ- ing watchmen, and excluding superintendents, foremen, assistant foremen, employees in the main office, pattern makers and pattern makers' apprentices, as their representative for the purposes of col- lective' bargaining, and that pursuant to the provision of Section 9 (a) of the Act, the American Federation of Labor, Federal Local No. 22636, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
