ORDER
The parties’ Joint Motion to Sever Allegations and Partially Remand to the
Regional Director for Approval of Partial Withdrawal Request is granted. Accordingly,
this matter is remanded to the Regional Director for Region 21 of the National Labor
Relations Board for further appropriate action.1

Member Miscimarra believes that a Board award for front pay in lieu of reinstatement would exceed the
Board’s remedial authority under the Act. See Pacific Beach Hotel, 361 NLRB No. 65, slip op. at 22-26
(2014) (Member Miscimarra, concurring in part and dissenting in part). However, Member Miscimarra
notes that the approval of a settlement agreement does not constitute a Board finding regarding the
appropriateness of such an award.
