R-3519 and R-3550 CERTIFICATION OF REPRESENTATIVES Septe77iber 5; 19412 On April 7, 1942, the National Labor Relations,Board issued a Decision and Direction of Elections in the above-entitled proceeding and on May 6, 1942, a Supplemental Decision and Amendment to Direction of Elections2 Pursuant to the Direction of Elections,,as amended, elections by secret ballot were conducted among all cannery employees of Columbia River Packers Association, Inc., herein called the Company, at its Ellsworth plant on May 18, 1942, and among all cannery employees of the Company at its Altoona plant,on August 13, 1942, under the direction and supervision of the Regional Director for the Nineteenth Region (Seattle, Washington). On May 20, 1942, with respect to the election among the employees of the Ellsworth plant, and on August 18, 1942, with respect to the employees of the Altoona plant, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, issued and duly served upon the parties Election Reports on the ballots. - As to the balloting and its results, the Regional Director reported, with respect to the election among the employees at the Ellsworth plant, as follows : Total on eligibility list-------------------------------------- 86 Total ballots cast--'---------------------------------------- 321 Votes cast for Columbia River Gillnet Fishermen's Union and Affiliated Cannery Workers, A. F. L----------------------- 16 Votes cast for Columbia River Fishermen's Protective Union, C. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9,, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Columbia River Gillnet Fishermen's Union and Affiliated Cannery Workers, Chartered by- the Seafarers' International Union of North America, affiliated with the American Federation of Labor, has been designated and selected by a majority of all cannery employees of Columbia River Packers Association, Inc., at its Ellsworth plant, Ellsworth, Washington, excluding all machin- ists and truck drivers, launch men employed as buyers, buyers, station foremen, foremen and assistant foremen, and clerical employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Columbia River Gillnet Fisher- men's Union and Affiliated Cannery Workers, Chartered by the Sea- farers' International Union of North America, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment; and IT IS HEREBY CERTIFIED that Columbia River Gillnet Fishermen's Union and Affiliated Cannery Workers, Chartered by the Seafarers' International Union of North America, affiliated with the American Federation of Labor, has been designated and selected by a majority of all cannery employees of Columbia River Packers Association, Inc., at its Altoona plant, Altoona, Washington, excluding all machinists "Since they could have no possible effect on the outcome of the election, no suhng was made on the tno challenged ballots" It appears that the number of challenged ballots, which were not counted ( 2), and the number of " total valid ballots cast" ( 19), which were counted , total 21. 1004 DECISIONS' OF" NATIONAL LABOR RELATIONS BOARD and truck drivers, launch men, employed as buyers , buyers, station foremen, foremen ' and assistant foremen, and clerical employees, as their representative for, the purposes of collective bargaining, and that,' pursuant to Section 9 (a) of the Act, Columbia River Gillnet Fishermen's Union and Affiliated Cannery Workers, Chartered by the Seafarers ' International Union of North America, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining with re- spect to rates of pay, wages , hours of employment , and other condi- tions of employment.
