NUHW’s Motion states that it will not file exceptions to Administrative Law Judge Gerald M. Etchingham’s Report and Recommendations on Objections; it waives its right to a decision by the Board on the objections filed by the Intervenor; and it agrees to the setting aside of the election held in this case and proceeding to a second election. No opposition was filed to the Motion to Remand. Having duly considered the matter, the Board grants the Motion to Remand. Accordingly, this case is remanded to the Regional Director for Region 32 for further appropriate action, including the scheduling of a new election. In view of this remand, the exceptions filed by the Intervenor and the Employer to the Administrative Law Judge’s Report are moot, and will not be considered by the Board. Dated, April 23, 2012.
