Sep. 5, 2012) Copy Citation NOT INCLUDED IN HGB BOUND VOLUMES Thackerville, OK UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD CHICKASAW NATION operating WINSTAR WORLD CASINO and Case 17-CA-025031 17-CA-025121 INTERNATIONAL BROTHERHOOD OF TEAMSTERS LOCAL 886, affiliated with THE INTERNATIONAL BROTHERHOOD OF TEAMSTERS CORRECTED ORDER APPROVING STIPULATION, GRANTING MOTION, AND TRANSFERRING PROCEEDING TO THE BOARD On July 10, 2012, the Acting General Counsel of the National Labor Relations Board, through the Regional Director for Region 17, issued an amended consolidated complaint alleging that the Chickasaw Nation d/b/a WinStar World Casino (the Nation), by informing employees that they did not have the protection of the National Labor Relations Act because of tribal sovereignty, has interfered with, restrained, and coerced employees of the WinStar World Casino in their exercise of the rights guaranteed in Section 7 of the Act, in violation of Section 8(a)(1) of the Act. On July 19, 2012, the Nation, International Brotherhood of Teamsters Local 886, and the Acting General Counsel filed with the Board a Joint Statement of Issues and Joint Statement of Stipulated Facts and a Joint Motion to Transfer Proceeding to Board on Stipulated Record. The parties agree that the Joint Statement of Issues and Joint Statement of Stipulated Facts, if approved, provides for an appealable decision by the Board. The parties have further waived a hearing by an administrative law judge and have submitted the case directly to the Board for an expedited Decision and Order. The parties have requested that the Board set a time for the filing of briefs. The Board having considered the matter, IT IS ORDERED that the Joint Motion to Transfer Proceeding to Board on Stipulated Record is granted and the case is transferred to and continued before the Board in Washington, D.C. for the purpose of making findings of fact and conclusions of law and the issuance of a Decision and Order. IT IS FURTHER ORDERED that the Joint Statement of Issues and Joint Statement of Stipulated Facts, the Stipulated List of Exhibits, Exhibits 4(a)-4(o), and the Respondent’s Stipulation and Waiver are approved and made a part of the record. The Acting General Counsel and International Brotherhood of Teamsters Local 886 may file opening briefs with the Board in Washington, D.C. on or before October 4, 2012. The Respondent may file an answering brief on or before November 5, 2012. Reply briefs may be filed on or before November 26, 2012.
