I)(ICISION AND ORDE[R BYM IMIIRS JNKINS, MRIIY .\NI) I' I R I SI)AI On August 30, 1977, the National I.abor Relations Board issued a Decision and Order' in the above- entitled proceeding in which it ordered, inter alia. that Respondent reimburse unit employees for any losses they may have suffered by reason of its refusal to sign a collective-bargaining agreement in violation of Sec- tion 8(a)(5) and (1) of the National Labor Relations Act, as amended. Thereafter, on July 14, 1978, in an unpublished decision, the U.S. Court of Appeals for the Ninth Circuit entered its judgment enforcing the Board's Order in full. A controversy having arisen over the amount of backpay due the employees under the terms of the Board's Order, as enforced by the court, the Regional Director for Region 21. on May 22, 1979, issued and duly served on Respondent, by registered mail, a backpay specification and notice of hearing, alleging the amount of backpay and other benefits due and notifying Respondent of its obliga- tion to file a timely answer complying with the Board's Rules and Regulations, Series 8. as amended. On June 28, 1979, Respondent filed an answer to the backpay specification. Thereafter, on August 7, 1979, counsel for the Gen- eral Counsel filed a motion to strike Respondent's an- swer to the backpay specification and a Motion for Summary Judgment. On August 15. 1979, the Board issued an order transferring proceeding to the Board and Notice To Show Cause why the General Coun- sel's Motion for Summary Judgment should not be granted. On September 4. 1979. Respondent tiled an answer to order transferring proceedings to the Board. Pursuant to the provisions of Section 3(b) of the National abor Relations Act, as amended, the Na- tional Labor Relations Board has delegated its au- thority in this proceeding to a three-member panel. Upon the entire record in this proceeding. the Board makes the following: Ruling on the Motion fr Summary .l udgment For the reasons discussed below, we have decided to grant the General Counsel's Motion for Summary Judgment. As noted in an earlier decision, the Board found that Respondent had violated Section 8(a)(5) and (1) of the Act by failing and refusing to execute a written contract which embodied the terms of a previously agreed-upon oral agreement. The Ninth Circuit Court of Appeals subsequently enforced the Board's Order in full. Nevertheless, in response to paragraphs I. 2. 3, 5. 6, 8, 9. 14. 15, 16, 17, 18, and 19 of the backpay specification. Respondent argues, the Board and court decisions notwithstanding, that it is not now nor has it ever been a signatory to, or obligated under, a collective-bargaining agreement with the Charging Party, and therefore it is under no obligation to com- ply with the terms thereof. Counsel for the General Counsel contends that by this response t the specifi- cation Respondent is seeking to relitigate issues previ- ously adjudicated adversel, to it rather than address- ing the issue of backpay liability which is the subject of this proceeding. We agree. The question of Re- spondent's status as a signatoro to the relevant collec- tive-bargaining agreement, with all its attendant obli- gations, has been established to the satisfaction of the Board and court in prior proceedings. Inasmuch as Respondent's answer to the above-noted paragraphs '231 NLRB 797. 246 NLRB No. 158 986 CHARLES SPORTSWEAR ANUIFACTURING CO. of the backpay specification is neither responsive thereto nor raises issues properly considered in this proceeding, we deem those allegations of the specifi- cation to be admitted to be true without the taking of additional evidence. In paragraph 4 of the specification, the General Counsel sets forth the monthly Consumer Price In- dexes for the backpay period as prepared by the U.S. Bureau of Labor Statistics of the Department of La- bor. In its answer, Respondent denies the allegation in this paragraph of the specification based on the lack of information and belief. The General Counsel argues that the Board may take administrative notice of the Consumer Price Index. We agree and shall ex- ercise our administrative discretion to take notice of the allegations in paragraph 4 of the specification. In paragraph 10 of the specification, the General Counsel alleges that certain employees were em- ployed by Respondent from October I. 1975, through February 28. 1978. the relevant dates herein. Respon- dent denies this allegation on the basis that it had terminated the operation of its business prior to the middle of February 1978. We agree with the General Counsel's contention that this denial lacks the requi- site specificity to place this matter in issue.- We there- fore find that this allegation is deemed to be admitted to be true. Therefore. xwe deem these allegations to be admitted to hb true. Accordingl, on the basis of the allegations of the specification which are accepted as true, the Board finds the facts as set forth therein. concludes the net backpay and benefit payments due the emplo\ees at'- fected by Respondent's unlawful conduct is as stated in the computations in the specification, and accord- ingly orders that payment in accord with the backpay specification be made by Respondent.' ORDER Pursuant to Section I0(c) of the National Labor Relations Act, as amended. the National Labor Rela- tions Board hereby orders that the Respondent.
