May. 21, 2012) Copy Citation Columbus, OH UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD CENTER CITY INTERNATIONAL TRUCKS, INC. and INTERNATIONAL ASSOCIATION OF MACHINISTS & AEROSPACE WORKERS, AFL-CIO, DISTRICT LODGE 54, LOCAL LODGE 1471 Cases 09-CA-045338 09-CA-045402 09-CA-045437 09-CA-045820 09-CA-045975 09-CA-046081 09-CA-046136 09-CA-046183 ORDER On September 2, 2011, Administrative Law Judge Ira Sandron of the National Labor Relations Board issued his Decision in the above-entitled proceeding and, on the same date, the proceeding was transferred to and continued before the Board in Washington, D.C. The Administrative Law Judge found that the Respondent has engaged in certain unfair labor practices, and recommended that it take specific action to remedy such unfair labor practices. Subsequently, the Acting General Counsel and the Respondent filed exceptions to the Administrative Law Judge’s Decision and briefs in support, the Acting General Counsel filed an answering brief in response to Respondent’s exceptions, and the Respondent filed a reply brief in response to the Acting General Counsel’s answering brief. Thereafter, on March 9 and April 19, 2012, the Respondent filed notices of withdrawal of exceptions. On April 20, 2012, the Acting General Counsel filed a motion to withdraw cross- exceptions. By an unpublished Order, dated May 18, 2012, the Board granted the Respondent’s and Acting General Counsel’s requests to withdraw exceptions. As no exceptions to the Administrative Law Judge’s Decision remain, pursuant to Section 10(c) of the National Labor Relations Act, as amended, and Section 102.48 of the 2 National Labor Relations Board Rules and Regulations, the Board adopts the findings and conclusions of the Administrative Law Judge as contained in his Decision, and orders that the Respondent, Center City International Trucks, Inc., its officers, agents, successors, and assigns, shall take the action set forth in the recommended Order of the Administrative Law Judge.
