May. 21, 2012) Copy Citation Columbus, OH UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD CENTER CITY INTERNATIONAL TRUCKS, INC. and INTERNATIONAL ASSOCIATION OF MACHINISTS & AEROSPACE WORKERS, AFL-CIO, DISTRICT LODGE 54, LOCAL LODGE 1471 Cases 09-CA-060153 09-CA-060157 ORDER On November 15, 2011, Administrative Law Judge George Carson II of the National Labor Relations Board issued his Decision in the above-entitled proceeding and, on the same date, the proceeding was transferred to and continued before the Board in Washington, D.C. The Administrative Law Judge found that the Respondent has engaged in certain unfair labor practices, and recommended that it take specific action to remedy such unfair labor practices. Subsequently, the Acting General Counsel and the Respondent filed exceptions to the Administrative Law Judge’s Decision and briefs in support, the Acting General Counsel filed an answering brief in response to Respondent’s exceptions, and the Respondent filed a reply brief in response to the Acting General Counsel’s answering brief. Thereafter, on March 9, 2012, the Respondent filed a notice of withdrawal of exceptions. On April 20, 2012, the Acting General Counsel filed a motion to withdraw cross-exceptions. By an unpublished Order, dated May 18, 2012, the Board granted the Respondent’s and Acting General Counsel’s requests to withdraw exceptions. As no exceptions to the Administrative Law Judge’s Decision remain, pursuant to Section 10(c) of the National Labor Relations Act, as amended, and Section 102.48 of the 2 National Labor Relations Board Rules and Regulations, the Board adopts the findings and conclusions of the Administrative Law Judge as contained in his Decision, and orders that the Respondent, Center City International Trucks, Inc., its officers, agents, successors, and assigns, shall take the action set forth in the recommended Order of the Administrative Law Judge.
