The Petitioner’s and Employer’s Requests for Review of the Regional Director’s
Decision and Order are denied as they raise no substantial issues warranting review.1

1 In denying review, we agree that the Regional Director properly declined jurisdiction under
Pacific Lutheran University, 361 NLRB No. 157 (2014). We therefore find it unnecessary to
pass on the remaining issues raised in the Petitioner’s and Employer’s Requests for Review.
Member Miscimarra adheres to his dissenting views expressed in Pacific Lutheran
University, but nevertheless agrees that, even applying the standard articulated in that case, the
Regional Director properly declined jurisdiction.
Chairman Pearce would grant the Petitioner’s and Employer’s Requests for Review with
respect to the Regional Director’s findings that the Employer is not subject to the Board’s
jurisdiction under Pacific Lutheran University, and that the petitioned-for tenured and tenure-
track faculty members are managerial employees. He would deny review in all other respects.
