Further to the Alnylam Request for Adverse Judgment, filed 13 November 2012
(Paper 201), it is
ORDERED that judgment on priority as to Count 5 (the sole count in the
interference; Paper 194) is awarded against Junior Party Alnylam.
FURTHER ORDERED that claims 1-6, 8, 10, 12-18, 21-22 and 32-33 of
Alnylam U.S. Patent 7,718,629 be CANCELLED and
FURTHER ORDERED claims 32-38 of Alnylam U.S Patent Application
13/165,568 are FINALLY REFUSED. 35 U.S.C. § 135(a).
FURTHER ORDERED that attention is directed to 35 U.S.C. § 135(c) Bd.
R. 205 regarding the filing of settlement agreements.
FURTHER ORDERED that a copy of this JUDGMENT shall be placed in
the files of (1) Alnylam U.S. Patent 7,718,629, (2) Alynlam U.S. Patent Application
13/165,568, and (3) Protiva U.S. Patent Application 11/807,872.
