DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE On August 8, 1941, United Construction Workers Organizing Com- mittee, Local 324, C. I. 0., hereinafter called the C. I. 0., filed with the Regional Director for,the Fourteenth Region (St. Louis; Mis- souri) a petition alleging that a question affecting commerce had arisen concerning the representation of employees of Broderick & Bascom Rope Co., St. Louis, Missouri, herein called the Company, engaged in the manufacture, sale, and distribution of wire-rope cables, and requesting an investigation and certification of represent- atives pursuant to Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, herein called the Act. On October 3, 1941, the National Labor Relations Board, herein called the Board, acting pur- suant to Section 9 (c) of the Act, and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ordered an investigation and authorized the Regional Director to conduit it and to provide for an appropriate hearing upon due notice. R B , No. 243. 1193 1194 DECISIONS OF NATIONAL LABOR RELATIONS BOARD International Brotherhood of Electrical Workers, Local No. 1, A. F. L., International Union of Operating Engineers, Locals 2, 2A, and 2B, labor organizations claiming to represent employees directly affected by this investigation, herein collectively called the A. F. L. Locals, and the Board entered into a "STIPULATION FORiCERTIFICATION OF REPRESENTATIVES UPON CON- SENT ELECTION." Pursuant to the Stipulation, an election by secret ballot was con- ducted on October 21, 1941, under the direction and supervision of the Regional Director, among all production and maintenance em- ployees of the Company, excluding clerical, office, supervisory, and assistant supervisory employees and watchmen, to determine whether they desire to be represented by the C. I. 0., or by the A. F. L. Locals, for the purposes of collective bargaining, or by neither. On October 27, 1941, the Regional Director issued and duly served upon the parties his ,Election Report on the ballot. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. I. 0 ---- 110 Number of ballots voted for American Federation of Labor and its Affiliated Locals--------------------------------------- 78 Number of ballots voted for Neither-------------------------- 2 Upon the basis of the Stipulation, the Election Report, and the entire record in the case, the Board makes the following : FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the represen- tation of employees of Broderick & Bascom Rope Co., St. Louis, Mis- souri, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. - -2. All production and maintenance employees of the Company, excluding clerical, -office, supervisory, and assistant supervisory em- ployees and watchmen, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act. 3. United Construction Workers Organizing Committee, Local 324, affiliated with the C. I. 0., has been designated and selected by a BRODERICK & BASCOM ROPE CO. 1195 majority of the employees in the above unit as their representative for the purposes of collective bargaining, and is the exclusive repre- sentative of all employees in said unit within the meaning of Section 9 (a) of the-National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES ! z s By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, IT IS HEREI3Y CERTIFIED that United Construction Workers Organiz- ing Committee, Local 324, affiliated with the C. I. 0., has been desig- nated and selected by a majority of all production and maintenance employees of Broderick & Bascom Rope Co., St. Louis, Missouri, ex- cluding clerical, office, supervisory, and assistant supervisory em- ployees and watchmen, as their representative for the purposes of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the Act, United Construction Workers Organizing Committee, Local 324, affiliated with the C. I. 0., is the exclusive representative of all such employees for the purposes of,collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
