LOCAL UNION NO. 137 Petitioner Case 21-RC-075974 DECISION AND CERTIFICATION OF RESULTS OF ELECTION The National Labor Relations Board has considered objections and determinative challenged ballots in an election held April 13, 2012, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 11 ballots cast for and 21 ballots cast against the Petitioner, with 11 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations,1 and finds that a certification of results of election should be issued. 1 The Board adopts the Regional Director’s recommendation to overrule the Petitioner’s objections and to sustain the challenges to the ballots of Juan Contreras, Ernesto Padilla, Jose A. Malvaez, Arnulfo Gonzales, Daniel Martinez, and Arnulfo Aguilar. Accordingly, the Regional Director did not resolve the remaining five challenged ballots of Phil Houser, Frederico Romero, Agustin Ramos, Pat Ford, and Mary Tovar, as these ballots were no longer determinative. 2 CERTIFICATION OF RESULTS OF ELECTION IT IS CERTIFIED that a majority of the valid ballots have not been cast for Glass, Molders, Pottery, Plastics & Allied Workers, AFL-CIO, CLC, G.M.P. Local Union No. 137, and that it is not the exclusive collective-bargaining representative of these bargaining unit employees. Dated, Washington, D.C., June 12, 2012.
