TERMINATION Due to Settlement after Institution of Trial 35 U.S.C. § 317; 37 C.F.R. § 42.74 The parties have requested that this trial be terminated pursuant to a settlement. On July 27, 2018, we authorized the parties via e-mail to file a joint request to terminate this proceeding and to file the settlement agreement as business confidential information under 37 C.F.R. § 42.74(c). The parties filed a Joint Motion to Terminate Inter Partes Review on August 25, 2020. Paper 43. The parties concurrently filed a copy of a written IPR2019-00768 Patent RE46,137 E 2 settlement agreement (Ex. 1050) along with a Joint Request to File Settlement Agreement as Business Confidential Information under 35 U.S.C. § 317(a). Paper 44, 1. We instituted trial on September 5, 2019. Paper 8. The parties indicate that they have agreed to resolve their dispute related to the challenged patent. Paper 43, 1. Although the deadline for entering a final decision in this proceeding is approaching, under the circumstances, we determine that it is appropriate to enter judgment and terminate the trial without rendering a final written decision. 37 C.F.R. § 42.72. Accordingly, it is ORDERED that the Joint Motion to Terminate Inter Partes Review, Paper 43, is granted; FURTHER ORDERED that the Joint Request to File Settlement Agreement as Business Confidential Information under 35 U.S.C. § 317(a), Paper 44, is granted; and FURTHER ORDERED that the Settlement Agreement (Ex. 1050) shall be treated as business confidential information and kept separate from the public record under the provisions of 35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(c).
