DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE On December 6, 1941, International Fur and Leather Workers Union, C. I. 0., herein called the Union, filed with the Regional Di- rector for the Sixth Region (Pittsburgh, Pennsylvania) a petition, and on January 20, 1942, an amended petition, alleging that a question affecting commerce has arisen concerning the representation-of em- ployees of the Armour Leather Company, herein called the Company, engaged at Gleasonton, Pennsylvania, in the business of tanning sole leather, and requesting an investigation and certification of repre- sentatives pursuant to Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, herein called the Act. On February 24, 1942, the National Labor Relations Board, herein called the Board, acting pur- suant to Section 9 (c) of the Act and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ordered an investigation and authorized the Regional Director to conduct it and to provide for an appropriate hearing upon due notice. On February 19,1942, the Board, the Company, the Union, and North Bend Leather Workers Association, unaffiliated, herein called the Association, entered into a "STIPULATION FOR -CERTIFICATION UPON CONSENT ELECTION." , On March 3, 1942, the Company, the Union, and 39 N. L R. B, No. 221. . 1193 1194 DECISIONS OF NATIONAL LABOR RELATIONS BOARD the Association entered into a "Supplementary Agreement" to the said "STIPULATION FOR CERTIFICATION UPON CONSENT ELECTION." Pursuant to the Stipulation and the Supplementary Agreement, an election by secret ballot was conducted on March 5, 1942, under the direction and supervision of the Regional Director among all production and maintenance employees of the Company at its plant in Gleasonton, Pennsylvania, including powerhouse employees, but excluding watchmen, traveling construction employees, and clerical and supervisory employees, to determine whether the said employees desire to be represented by the Union, by the Association, or by neither, for purposes of collective bargaining. On March 11, 1942, the Regional Director issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. I. 0.-------------------------------------------------- 86 Votes cast for North Bend Leather Workers Association, unaffiliated ----------------------------------------------- 9 Votes cast for neither-------------------------------------- 1 Upon the basis of the Stipulation, the Supplementary Agreement, the Election Report, and the entire record in the case, the Board makes the following : FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the rep- resentation of employees of- Armour Leather Company, Gleason- ton, Pennsylvania, within the meaning of Section 9 (c) and Sec- tion 2 (6) and (7) of the Act. - 2. All production and maintenance employees of the Company at its plant at Gleasonton, Pennsylvania, including powerhouse em- ployees, but excluding watchmen, traveling construction employees, and clerical and supervisory employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the Act. 3. International Fur and Leather Workers Union, C. I. 0., has been designated and selected by a majority of the employees in the above unit as their representative for the purpose of collective bar- ARMOUR LEATHER COMPANY 1195 gaining, and is the exclusive representative of all the employees in said unit , within the meaning-of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in,the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, IT IS HEREBY , CERTIFIED that International Fur and Leather Work- ers Union, C. I. 0., has been designated and-selected by a majority of all the-production and maintenance employees of Armour Leather Company at its plant at Gleasonton, Pennsylvania, including power- house employees, but excluding watchmen, traveling construction employees, and clerical and supervisory employees, as their representa- tive for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, International Fur and Leather Workers Union, C. I. 0., is the exclusive repre- sentative of all such employees for the purposes of collective bar- gaining, in respect to rates of pay, wages, hours of employment, and other conditions of employment.
