JUDGMENT Termination of the Proceeding 37 C.F.R. § 42.73 On February 26, 2014, the parties filed a joint motion to terminate this proceeding, and, on February 28, 2014, a true copy of their written agreement, settling their dispute in the instant proceeding, in accordance with 37 C.F.R. § 42.74(b). Paper 11; Ex. 1026. During the telephone conference with the Board on February 27, 2014, the parties represented that there are no oral or other written agreements associated with this settlement and that this settlement does not terminate any other proceeding, including the co-pending litigation between the Case IPR2014-00030 Patent 7,103,380 2 parties. See Paper 2, 5–6; Paper 9, 2. The Board has not instituted trial, does not have before it full briefing on the trial issues, and has not entered a final decision. Accordingly, it is appropriate to enter judgment terminating this proceeding, without rendering a final written decision.
