ORDER TRANSFERRING PROCEEDING TO THE BOARD
and
NOTICE TO SHOW CAUSE
On November 9, 2018, the General Counsel filed with the National Labor
Relations Board a Motion for Partial Summary Judgment on the grounds that certain
paragraphs of the Respondent’s answer to the compliance specification: (1) fail to meet
the requirements of Section 102.56(b) of the Board’s Rules and Regulations because
they are not specific as to matters in dispute and fail to provide alternative presumptions
and calculations; (2) deny allegations that are within the Respondent’s knowledge; (3)
raise issues that are not properly litigable at this stage of the proceedings because
those issues have already been litigated and decided by the Board and enforced by the
United States Court of Appeals for the District of Columbia Circuit; (4) are contrary to
the remedies ordered by the Board; or (5) are admitted by the Respondent. The

Respondent did not file a response to the General Counsel’s motion. Having duly
considered the matter,
IT IS ORDERED that the above-entitled proceeding be transferred to and
continued before the Board in Washington, D.C.
NOTICE IS GIVEN that cause be shown, in writing, filed with the Board in
Washington, D.C., on or before February 14, 2019 (with affidavit of service on the
parties to this proceeding), why the General Counsel’s motion should not be granted.
Any briefs or statements in support of the General Counsel’s motion shall be filed by the
same date.
