C-518 and R-470 ORDER DISMISSING PETITION September 27, 1941 On May 4, 1939, the National Labor Relations Board, herein called the Board, issued a Decision, Order, and Direction of Election in the above-entitled consolidated cases.' The Direction of Election directed that an election be held, at such time as the Board might thereafter direct, among all the production and maintenance em- ployees of the American Petroleum Company, Houston, Texas, at its Norsworthy, Texas, plant and upon its pipe lines, who were em- ployed by the Company within a period to be determined by the Board in the future, but excluding office and clerical employees, fore- men, straw bosses, and other supervisory employees, to determine whether or not they desired to be represented by Oil Workers' Inter- national Union, Local No. 227, affiliated with the Committee for Industrial Organization, for the purposes of collective bargaining. In view of the lapse of time since the Direction of Election, the Board will not proceed with a determination of representatives upon the basis of the record heretofore made in this proceeding. Accord- ingly, the petition upon which this proceeding is based will be dis- missed, without prejudice, however, to the right of the Oil Workers' International Union, Local No. 227, to file a new petition requesting an investigation and certification of representatives pursuant to Section 9 (c) of the Act.
