On January 17, March 2, and April 28, 1942, respectively, the Board issued an Amendment to Direction of Election,2 a Second Amendment to Direction of Election,3 and a Third Amendment to Direction of Election." Pursuant to the Direc- tion of Election, as amended, an election by secret ballot was con- ducted on May 6, 1942, under the direction and supervision of the Regional Director for the Fifth Region (Baltimore, Maryland). On May 8, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. B., No. 44. 202 AMERICAN OIL COMPANY 203 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT 'IS HEREBY CERTIFIED that Truck Drivers & Helpers, Local 355, International Brotherhood of Teamsters, Chauffeurs, Warehousemen and Helpers of America (AFL) has been designated and selected by a majority of the monthly salaried truck drivers employed at the American Oil Company's" places of business at 26th and Hampden Streets, known as Liberty plant, and Clarkson Street, in Baltimore, Maryland, excluding persons employed on a temporary basis and those who are paid on an hourly rate and that, pursuant.to Section 9 (a) of the Act, Truck Drivers & Helpers, Local 355, International Brotherhood of Teamsters, Chauffeurs, Warehousemen and Helpers of America (A. F. L.) is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
