Jun. 5, 2012) Copy Citation UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD ALLIED AVIATION SERVICE COMPANY OF NEW JERSEY Employer and Case 22-RC-077044 LOCAL 553, INTERNATIONAL BROTHERHOOD OF TEAMSTERS Petitioner ORDER Employer’s Request for Review of the Regional Director’s Decision and Direction of Election raises a substantial issue solely with regard to the Regional Director’s finding that the Training Supervisors are not supervisors under the Act. The Board concludes, however, that the issue can best be resolved through the use of the challenge procedure. Accordingly, the Regional Director’s Decision is amended to permit the Training Supervisors to vote by challenged ballot, and the Employer’s Request for Review is denied in this and all other respects.1 International Association of Machinists and Aerospace Workers’ motion to reopen the record and intervene in the instant case is also denied. MARK GASTON PEARCE, CHAIRMAN RICHARD F. GRIFFIN, JR., MEMBER SHARON BLOCK, MEMBER Dated, Washington, D.C., June 5, 2012. 1 The Employer seeks to disqualify Board Members Block, Griffin, and Flynn from ruling in this proceeding, arguing that their recess appointments to the Board by the President were not properly constituted. For the reasons set forth in Center for Social Change, Inc., 358 NLRB No. 24 (2012), we reject this argument. Member Flynn is recused and took no part in the consideration of this case.
