Employer and PUBLIC SERVICES EMPLOYEES LOCAL UNION 572 a/w LABORERS' INTERNATIONAL UNION OF NORTH AMERICA, AFL-CIO Petitioner Case 05-RC-109272 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered an objection to an election held August 21, 2013, and the Regional Director's report recommending disposition of it. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 11 ballots cast for and 1 ballot cast against the Petitioner, with 0 void ballots and 0 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations, and finds that a certification of representative should be issued. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Public Services Employees, Local 572, Affiliated with Laborers' International Union of North America and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular-time employees employed by the Employer who perform landscaping duties at the Fort McNair, Washington, DC and Fort Myer, Virginia locations, but excluding all clerical, administrative, professional, confidential, and managerial employees, guards and supervisors as defined by the Act.
