Section 1716-A.1 - Hospital uncompensated care payments and reimbursements for extraordinary expense report.(a)Report.--The following shall apply: (1) On or before December 31, 2016, the department of human services shall issue a report that compares the differences among the following:(i) The payments made by the department of human services to eligible hospitals under chapter 11 of the act of June 26, 2001 ( P.L. 755, No.77), known as the tobacco settlement act, for each fiscal year from fiscal year 2009-2010 through fiscal year 2014-2015;(ii) The payments which would have been made by the department of human services under chapter 11 of the tobacco settlement act for each fiscal year from fiscal year 2009-2010 through fiscal year 2014-2015 if the department had redistributed the payments based on reports issued by the auditor general; and(iii) The payments which would be made by the department of human services to eligible hospitals under chapter 11 of the tobacco settlement act for each fiscal year from fiscal year 2009-2010 through fiscal year 2014-2015 if the payments were to be recalculated based on the most current data for each fiscal year.(2) The report shall analyze the impact, if any, to eligible hospitals and the commonwealth if the redistribution for fiscal year 2009-2010 through fiscal year 2014-2015 was to occur on or prior to June 30, 2017. The analysis under this paragraph shall include analysis of payment changes to or from eligible hospitals and the commonwealth from medicaid disproportionate share hospital payments or other federal program payments.(3) The department of human services shall cause the report to be published on the department's publicly accessible internet website and shall submit a copy of the report to the chairperson and minority chairperson of the appropriations committee of the senate, the chairperson and minority chairperson of the public health and welfare committee of the senate, the chairperson and minority chairperson of the appropriations committee of the house of representatives and the chairperson and minority chairperson of the health committee of the house of representatives.Added by P.L. 664 2016 No. 85, § 13, eff. 7/13/2016.
