If an appealing party no longer wants to pursue an appeal after the notice of appeal is filed, but before the respondent files any motion or brief, a notice of withdrawal of appeal must be filed with the district court, and the appeal cost bond will be returned to the posting party. If the respondent has filed a motion or brief, the appellant must obtain the consent of the respondent and submit a stipulation and order to dismiss the appeal that is signed by the respondent and that addresses the status of the bond, whether to be returned to the appellant or if it is awarded to the respondent for any incurred costs.
