Section 7 AAC 100.204 - Eligibility(a) Transitional Medicaid begins the first month after the month the department (1) terminates Family Medicaid eligibility; or(2) would have terminated Family Medicaid eligibility had (A) the household timely reported increased earnings as required under 7 AAC 100.900; and(B) the department acted within 10 days after receiving that report to provide timely notice of proposed agency action under 7 AAC 49.060.(b) Eligibility for Transitional Medicaid continues for 12 months if the (1) household continues to reside in the state;(2) household continues to include a dependent child, as determined under 7 AAC 100.104(a) (1); and(3) caretaker relative continues to cooperate with(A) the department in recovery of third-party resources as required under 7 AAC 100.034; and(B) the child support services agency as required under 7 AAC 100.042.(c) Only the caretaker relative may be ineligible for Medicaid benefits for failure to cooperate under (b)(3) of this section.Eff. 7/20/2007, Register 183; am 10/1/2009, Register 191Authority:AS 47.05.010
