Section 7 AAC 100.204 - Eligibility
(a) Transitional Medicaid begins the first month after the month the department
(1) terminates Family Medicaid eligibility; or
(2) would have terminated Family Medicaid eligibility had
(A) the household timely reported increased earnings as required under 7 AAC 100.900; and
(B) the department acted within 10 days after receiving that report to provide timely notice of proposed agency action under 7 AAC 49.060.
(b) Eligibility for Transitional Medicaid continues for 12 months if the
(1) household continues to reside in the state;
(2) household continues to include a dependent child, as determined under 7 AAC 100.104(a) (1); and
(3) caretaker relative continues to cooperate with
(A) the department in recovery of third-party resources as required under 7 AAC 100.034; and
(B) the child support services agency as required under 7 AAC 100.042.
(c) Only the caretaker relative may be ineligible for Medicaid benefits for failure to cooperate under (b)(3) of this section.
