Section 7 AAC 100.106 - Deprivation
(a) To be eligible for Family Medicaid, a dependent child must be deprived of the parental support and care of one or both of the child's parents. Deprivation occurs
(1) when a parent does not continue to live in the home of the child, except for a temporary absence authorized under 7 AAC 100.112; or
(2) because of deficient employment of a parent.
(b) A child is deprived of parental support and care under (a)(1) of this section even if a divorced, legally separated, unmarried, hospitalized, or institutionalized parent with whom the child does not live has some contact with the child.
(c) A child living in a two-parent home is deprived of parental support and care because of deficient employment under (a)(2) of this section if one or more of the following circumstances exists:
(1) the household income does not exceed the Family Medicaid need standard established in 7 AAC 100.190;
(2) the home includes a pregnant woman who qualifies for Family Medicaid under 7 AAC 100.124.
