ORDER


On October 16, 2008, defendant Ramirez filed a request for a two-week extension of time to file a dispositive motion. On October 24, 2008, defendant filed his motion for summary judgment. Good cause appearing, defendant's request will be granted nunc pro tunc, and his motion for summary judgment will be deemed timely.

IT IS HEREBY ORDERED that:

1. Defendant's October 16, 2008 request for an extension of time (Doc. No. 40) is granted nunc pro tunc;

2. Defendant's October 24, 2008 motion for summary judgment is deemed timely; and

3. Plaintiff shall file an opposition or a statement of non-opposition to defendant's motion for summary judgment within thirty days of the date of service of this order. Defendant shall file a reply, if any, in accordance with Local Rule 78-230(m).
