ORDER
Plaintiff, who is proceeding pro se, brings this civil rights action under 42 U.S.C. § 1983. The matter was referred to a United States Magistrate Judge as provided by Eastern District of California local rules.
On December 5, 2022, the Magistrate Judge filed findings and recommendations, which were served on the parties and which contained notice that the parties may file objections within the time specified therein. Magistrate Judge also “warned that failure to file an amended complaint within the time provided in [the] order may be grounds for dismissal of this action.” Id. at 12. Plaintiff did not file an amended complaint and did not explain this lack of filing in her objections. See Obj.
Accordingly, IT IS HEREBY ORDERED:
1. The findings and recommendations filed December 5, 2022, are adopted in full;
2. This action is dismissed without prejudice for lack of prosecution and failure to comply with court rules and orders; and
3. The Clerk of the Court is directed to enter judgment and close this file.
