This case was continued from the Court's November 29, 2021, San Francisco, California, trial session, and jurisdiction was retained by the undersigned. On January 5, 2022, the parties filed a joint status report requesting that the Court set a briefing schedule for the filing of cross-motions for summary judgment. The parties further requested that the Court add this case to the Court's April 11, 2022, New York, New York, trial session, for the purpose of conducting a remote trial of any issues not addressed in the cross-motions for summary judgment. The parties noted their expectation that trial of the remaining issue(s) would likely consume no more than three hours. In consideration of the foregoing, it is
ORDERED that this case is set for a remote trial at a time and date certain of Tuesday, April 12, 2022, at 10:00 a.m. Pacific time (1 p.m. Eastern time), during the Court's April 11, 2022, New York, New York, trial session, at which the undersigned will be presiding. The parties need not appear at the calendar call on April 11, 2022. It is further
ORDERED that the Clerk of the Court shall serve on the parties a copy of the Standing Pretrial Order for that trial session and a notice of remote proceeding. It is further
ORDERED that the parties are directed to adhere to the following briefing schedule for cross-motions for summary judgment:
1. January 28, 2022: Last date to file any motions for summary judgment (including any motions for partial summary judgment) and opening memoranda in support thereof. The parties shall submit an additional stipulation of facts (if any is needed) at the time of filing any motion for summary judgment.
2. February 28, 2022: Last date to file responses to any motions for summary judgment.
This Order constitutes official notice of its contents to the parties.
