Proceedings upon petition by defendant for leave to file an appeal from summary conviction for violation of The Vehicle Code without payment of fine and costs imposed by magistrate. Order entered dismissing petition, opinion by McLEAN, Jr., J. Defendant appealed. Appeal, No. 147, April T., 1976, from Court of Common Pleas, Criminal Division of Allegheny County, No. SA-956 of 1975. Argued April 14, 1976.

James E. Mahood, with him Richard K. Brandt, for appellant; No appearance entered nor brief submitted for Commonwealth, appellee.


Order reversed and case remanded for a determination of indigency; if found indigent, appellant to be granted leave to appeal in forma pauperis without prepayment of fines and costs. Commonwealth v. Regan, 240 Pa. Super. 635, 359 A.2d 403 (1976).
