OF L.1 Case No. R-1874 SUPPLEMENTAL DECISION CERTIFICATION OF REPRESENTATIVES AND ORDER -September 24, 1940 On' July 27, 1940, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Elections in the above-entitled proceeding.2 Pursuant to the Direction of Elec- tions, elections by secret ballot were conducted on August 14, 1940, and August 17, 1940, under the direction and supervision of the Re- gional Director for : the Second Region (New York City). On August 30, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served upon the parties her Election Report. On September 7, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served her report on the objections of -the Company to the conduct of the secret ballot and the Election Report. The Board has considered the objections of the Company and finds that they do not raise substantial or material issues with respect to the conduct of the ballot or the Election Report. The objections are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT Is HEREBY CERTIFIED that International Brotherhood of Team- sters, Chauffeurs, Stablemen and Helpers of America, Local #202, affiliated with,the A. F. of L., has been designated and selected by a majority of all chauffeurs and chauffeur luggers at the Mineola and Jamaica Branches of the Company, at ,Long Island, New York, as their representative for the purposes of collective bargaining in WILSON & CO., INC. 425 each of the above-named branches, and that pursuant to the pro- visions of Section 9 (a) of the National Labor Relations Act, Inter- national Brotherhood of Teamsters, Chauffeurs, Stablemen and Helpers of America, Local #202, is the exclusive representative of all such employees in each of the above-named branches for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, , IT IS HEREBY ORDERED that the petition for investigation and certi- fication of representatives of the employees of Wilson & Co., Inc., in so far as it refers to the Beekman Branch of Wilson & Co., Inc., be and it hereby is dismissed.
