Cases Nos. 8-929 to R-936, inclusive CERTIFICATION OF REPRESENTATIVES December 15, 1938 On November 4, 1938, the National Labor Relations Board, herein called the Board, issued a Decision, Certification of Representatives, and Direction of Elections, in the above-entitled consolidated cases.,, The Direction of Elections directed that two separate elections by secret ballot be conducted among the processing and operative em- ployees of Wilson & Co. employed during the respective last pay-roll periods next preceding the date of the Direction at the Company's 161-2nd Street, Mineola plant, and at its Gotham Hotel Supply Co. plant, respectively, including chauffeur luggers, scalers, shipping clerks, cutters, egg handlers, sausage workers, and ham workers, and excluding supervisory employees, clerical employees, salesmen, and schoctim, and those who had since quit or been discharged for cause, to determine whether or not such employees desired to be represented by United Meat Workers Local Industrial Union No. 635, for the purposes of collective bargaining. Pursuant to the Direction of Elections,2 an election by secret ballot was conducted on November 18, 1938, at the Mineola plant, under the direction and supervision of, the Regional Director for the Sec- ond Region (New York City). Full opportunity was afforded all. parties to this investigation to participate in the conduct of the secret ballot and to make challenges. On November 21, 1938, the Regional 19 N. L. R . B. 650. 7 On November 19, 1938, the Board issued an Amendment to its Direction of Elections extending the period within which the election shall be held at the Gotham Hotel Supply Co. plant to such time as the Board may in the future direct. 9 N . B., No. 53. 675 676 NATIONAL LABOR RELATIONS BOARD Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served. upon the parties an Intermediate Report on the election. The Regional Director found that the objections raised no substantial and material issues with respect to the conduct of the ballot. The Board has considered the said objections and finds that no substantial and material issues tbith respect to the conduct of the ballot or to the Intermediate Report are raised thereby. By virtue of and pursuant to' the power vested in the National Labor Relations Board by Section 9'(c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III; Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1,' as amended, IT IS HEREBY CERTIFIED that United Meat Workers Local Industrial Union No. 635' has been 'designated and selected by a majority of the processing and operative employees of Wilson & Co. at its Mineola plant,' including chauffeur luggers, scalers, shipping clerks, cutters, egg handlers, sausage workers, and,ham workers, and excluding super-' visory employees, clerical employees, salesmen; and schoctim, ,as their representative for the purposes of collective bargaining, and that,' pursuant to Section 9 (a) of the Act, United Meat Workers Local Industrial Union No. 635 is the exclusive ' representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
