In the Matter' of WEINBERGER BANANA CO.,, INC., AND/OR WEINBERGER SALES Co., INC., AND/OR THEIR SUCCESSORS , ASSIGNS, RECEIVERS, TRUS- TEES, TRUSTEES IN BANKRUPTCY, CREDITORS ' COMMITTEE , OR OTHER REPRESENTATIVES ACTING IN BEHALF OF EITHER OR BOTH and UNITED DOCK AND FRUIT WORKERS' UNION Case No. R-768 ORDER DISMISSING PETITION June 09, 1940 A petition and amended petitions, pursuant to, Section 9 (c) of the Act, having been filed by United Dock and Fruit Workers' Union in Case No. R-768, the Board,' on December 27, 1939, having issued a' Decision, Order, and Direction of Election in Cases Nos. R-768 and 0-785, and,, by order duly made on May 3, 1940, 'having severed Cases Nos. C-785 and R-768, and certain designated members of the United Dock and Fruit Workers' Union having authorized a com- mittee to represent them in this proceeding and the said committee having requested permission to withdraw the petition in Case No. R-768, and, on June 20, 1940, the Board having given due notice that on June 28, 1940, or as soon thereafter as might be convenient, it would dismiss the petition for investigation and certification of representatives filed in Case No. R-768 and would close the aforesaid case,-and no objections having been filed with the Board, IT IS HEREBY ORDERED that the said petition be, and it hereby is, dismissed and that the aforesaid case be, and it hereby is, closed. 24 N.
