I. O. Case No. R-1897 CERTIFICATION OF REPRESENTATIVES August 6, 1940 On June 29, 1940, the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Election in the above- entitled proceeding.' Pursuant to the Direction of Election, an elec- tion by secret ballot was conducted on July 19, 1940, under the direc- tion and supervision of the Regional Director for the Twenty-first Region (Los Angeles, California). On July 23, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Amended Election Report.2 Full opportunity to participate in the conduct of the election and to make challenges was accorded to all parties. No objections to the conduct of the ballot or the Amended Election Report have been filed by any of the parties. The Regional Director reported the following results of the election: Total on eligibility list_________________________________ 2,378 Total ballots cast______________________________________ 1,968 Total ballots challenged_______________'_________________ 8 Total blank ballots____________________________________ 5 Total void ballots_____________________________________ 4 Total ballots not counted_______________________________ 17 Total ballots counted__________________________________ 1,951 Total votes for International Union United Automobile Workers of America, Local No. 683, C. I. 0_____________ 1, 439 Total votes against International Union United Automobile Workers of America, Local No. 683, C. I. 0------------- 512 Since the eight challenged ballots, if counted, would not affect the result of the election, they will be disregarded. 1 24 N. L R. B. 1184. On July 16, 1940, the International Association of Machinists, A. F. of L., moved the Board to set aside or modify its Decision and Direction of Election . On the same day the Board denied the motion. 3 On July 22 , 1940, the Regional Director issued and duly served upon the parties his Election Report. The Report was amended because of a minor typographical error. 26 N. L. R. B., No. 16. 135 136 DECISIONS OF NATIONAL LABOR RELATIONS BOARD By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that International Union United Automobile Workers of America, Local No. 683, affiliated with the Congress of Industrial Organizations, has been designated and selected bya ma- jority of all production and maintenance employees of Vultee Aircraft, Inc., Downey, California, excluding office workers, employees in the engineering department, pattern makers, welders, inspectors, super- visors, and officials who have the right to hire and discharge, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, International Union United Automobile Workers of America, Local No. 683, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other condi- tions of employment.
