The Direction of Election provided that an election by secret ballot be conducted, within fifteen (15) days from the date of the Direction, among all the employees at the Niagara plant of Vanadium Corpora- tion of America, Niagara Falls, New York, herein called the Coin- pany, whose names appear on the Company's pay roll for August 27, 1938, excluding executives, foremen, inspectors, recorders, watchmen, supervisors, and technical and clerical employees and 'excluding em- ployees who have since quit or been discharged for cause, to determine whether or not they desire to be represented by Local No. 12067, Gas & By-Product Coke & Chemical Workers Union, District 50, United Mine Workers of America, for the purposes of collective bargaining- Pursuant to the Direction of Election, an election by secret ballot was conducted on November 7, 1938, under the direction and super- vision of the Regional Director for the Third Region (Buffalo, New York). On November 9, 1938, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended; issued and duly served upon, the parties an Intermediate Report on the election. No objections or exceptions to the Intermediate Report have been filed by any of the parties.
