On October 25 the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. As to the balloting and its results, the Regional Director reported as follows: Total on eligibility list-------------------------------------- 499 Total ballots cast------------------------------------------ 486 Total votes cast for United Automobile Workers of America, Local 217 (CIO) ----------------------------------------- 258 Total votes cast against United 'Automobile Workers of Amer- ica, Local 217 (CIO) -------------------------------------- 224 Total blank ballots----------------------------------------- 0 Total void ballots------------------------------------------ 0 Total challenged votes-------------------------------------- 4 On October 30, 1940, The Standard Tool Company, Cleveland, Ohio, herein called the Company, filed with the Regional Director objections to the conduct of the ballot and to the Election Report. On November 14 the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served his Report on the objections of the Company to the conduct of the secret ballot and the 127 N. L. R. B. 599. 28 N. L R. B., No. 47. 279 280 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Election Report. On November 20 the Company by letter requested of the Board a hearing on its objections to the conduct of the ballot and to the Election Report. The Board has considered the objections of the Company and finds that they do not raise -substantial or material issues- with respect to the conduct of the ballot or the Election Report. The objections are hereby overruled. The "Request by The Standard Tool Company for Hearing on its Objections to the, Conduct of the Ballot and to the Election Report" is hereby denied. Since the four challenged ballots cannot affect the results of the electioli we find it unnecessary to pass upon the challenges. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act; 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as' amended, IT Is REREBY CERTIFIED that United Automobile Workers of America, Local, No. 217 (CIO), has been designated and se- lected by a majority of all hourly paid production and maintenance employees of The Standard Tool Company, Cleveland, Ohio, exclud- ing managerial foremen and assistant foremen, cafeteria utility em- ployees, factory-office and main-office employees, chief electrician, and stock chasers, as their representative for the purposes of collective bargaining,. and that, pursuant to Section 9 (a) of the National Labor Relations Act, United Automobile Workers of America, Local No. 217! (CIO), is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
