I. U. No. 198 (C. I. 0.) Case No. B-2013 SUPPLEMENTAL DECISION AND ORDER November 27, 1940, On September 10, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in this proceeding .1- Pursuant to the Decision and Direction of Election, an election by secret ballot was conducted on September 28, 1940, under the direction and supervision of the Regional Director for the Eighth Region (Cleveland, Ohio). On September 30, 1940, the Re- gional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. On October 7, 1940, United Brick Workers L. I. U. No. 198 (C. I. O.), herein called the Union, filed objections to the Election Report. On November 13, 1940, the Union requested permission to withdraw its objections. On November 15, 1940, the Regional Di- rector issued his Report on Objections and recommended that the Union's request to withdraw its objections be granted. The request is hereby granted. As to the balloting and its results, the Regional Director reported as follows : Total number of employees eligible------------------------- 192 Total number of ballots cast-------------------------------- 186 Total number of votes cast for United Brick Workers L. I. U. No. 198 (C. I. 0.)---------------------------- ----------- 87 Total number of votes against United Brick Workers L. I. U. No. 198 (C. The petition of United Brick Workers L. I. U. No. 198 (C. I. 0.) for investigation and certification of representa- tives of employees of The Niles Fire Brick Company, will therefore, be dismissed. ORDER By virtue of Section 9 -(c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 2, as, amended, IT Is HEREBY ORDERED that the petition for investigation and certi. fication of representatives of employees of The Niles Fire Brick Company, Niles, Ohio, is filed by United Brick Workers L.
