On November 29, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued an Election Report, copies of which were duly served on the parties.: As to the balloting and its results, the Regional Director reported as follows : Total number of eligible voters_____________________________ 468 Total number of ballots cast_______________________________ 406 Total number of votes for : Independent Employees Organization of the Martinsburg Plant, Standard Lime & Stone Co--------------------- 387 Total number of votes for : Local #175, Quarry Workers Union (C. I. 0.) ------------ 6 Total number of votes for neither__________________________ 12 Total number of blank ballots______________________________ 0 Total number of void ballots______________________________ 1 Total number of challenged votes__________________________ 0 On December 20, 1939 , Local #175 , Quarry Workers Union, herein called Local 175, filed with the Regional Director Objections to the Election Report. On December 22, 1939, the Regional Director , acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties a Report on Objections to Election Report in which he reported that the objections are without merit. The Board has considered the Objections to the Election Report and finds that they do not raise substantial or i naterial issues with respect to the conduct of the ballot or the Election Report. 1 17 N. B., No. 63. 617 618 DECISIONS OF NATIONAL LABOR RELATIONS BOARD By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, IT IS 'I-IEREBY CERTIFIED that Independent Employees Organization, of the Martinsburg Plant, Standard Lime & Stone Company, has been designated and selected by a majority of all employees in the Standard Lime & Stone Co., at its plant in Martinsburg, West Virginia, ex- cluding laboratory and office employees, officials, and foremen having subforemen under them, as their representative for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the Act, Independent Employees Organization of the Martinsburg Plant, Standard Lime & Stone Company is the exclusive representative of all such employees for the purpose of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
