VERNON INCORPORATED and LOCAL 21512, A. F. OF L. Case, R-18,25 CERTIFICATION OF REPRESENTATIVES August 18, 1940 On June 15, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election 1 in the above-entitled proceeding; and on June 22, 1940, it issued an Amend- ment to Decision and Direction of Election,2 and on July 3, 1940, a Second Amendment to Decision and Direction of Election.3 Pur- suant to the Direction of Election, as amended, an election by secret ballot was conducted on July 12, 1940, under the direction and super- vision of the Regional Director for the Second Region (New York City). On July 15, 1940, the Regional Director, act ng pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued her Election Report, copies of which were served on Local 21512, Motor & Bus Terminal Check- ers, Platform & Office Workers Union, A. F. of L., and on S. E. & M. Vernon Incorporated, herein called the Company. No objections to the conduct of the balloting or the Election Report have been filed by any of the parties.' As to the balloting and its results, the Regional Director reported as follows: Total number eligible to vote--------------------------- 366 Total number of ballots cast---------------------------- 347 Total number of valid ballots--------------------------- 340 Total number of votes in favor of Local 21512, Motor & Bus Terminal Checkers, Platform & Office Workers Union, A. VERNON INCORPORATED 549 By virtue of and pursuant to the power vested in the Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of said Rules and Regula- tions, IT IS HEREBY CERTIFIED that 'Local 21512, Motor & Bus Terminal Checkers, Platform & Office Workers Union, A. F. of L., has been designated and selected by a majority of the employees of S E. &'M. Vernon Incorporated at its factory in Elizabeth, New Jersey, exclu- sive of employees employed in the shipping department, foremen, assistant' foremen, and supervisory employees above the rank of foremen, as their representative for the purposes of collective bar- gaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Local 21512, Motor & Bus Terminal Checkers, Plat- form & Office Workers Union, A. F. of L., ,is the exclusive representa- tive of all such employees for the purposes of collective bargaining in respect to rates of pay, wages; hours of employment, and other conditions of employment.
