Rock River Woolen MillsDownload PDFNational Labor Relations Board - Board DecisionsFeb 10, 194020 N.L.R.B. 322 (N.L.R.B. 1940) Copy Citation In the Matter of ROCK RIVER WOOLEN MILLS and TExTILE WORKERS UNION OF AMERICA, AFFILIATED WITH CONGRESS OF INDUSTRIAL ORGANIZATIONS Case No. R-1615 SUPPLEMENTAL DECISION AND ORDER .February 10, 1940 On December 28, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceedings.' The Direction of Election provided that an election by secret ballot be conducted after fifteen (15) days but not later than thirty (30) days from the date, of the Direction among all production and maintenance employees of Rock River Woolen Mills, Janesville, Wisconsin, excluding supervisory and clerical employees and employees who have since quit or been discharged for cause, to determine whether or not they desire to be represented by Local 207, Textile Workers Union of America, affiliated with C. I. 0., for the purposes of collective bargaining. Pursuant to the Direction, the election by secret ballot was held on January 26, 1940, at Janesville, Wisconsin, under the direction and supervision of the Regional Director for the Twelfth Region. On January 29, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served upon the parties an Election Report containing a tally of the ballots. In his Report the Regional Director certified that the ballot was fairly and impar- tially conducted, that the ballots cast were duly and fairly counted under his supervision, and that statements to such effect had been filed with him by the observers. 1 18 N. Number of Votes FOR the Textile Workers Union of America, Local 207, affiliated with the Congress of Industrial Organi- zations------------------------------------------------- 107 5. Number of Votes AGAINST the Textile Workers Union of America, Local 207, affiliated with the Congress of Indus- trial Organizations-------------------------------------- 129 6. Number of Blank Ballots---------------------------------- 0 7. Number of Void Ballots----------------------------------- 0 8. Number of Challenged Ballots----------------------------- 0 No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. 'The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees in the appropriate unit. The petition of Textile Workers Union of America, affiliated with Congress of Industrial Organizations, for investigation and certification of representatives of employees of Rock River Woolen Mills will, therefore, be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449 , and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, it is hereby ORDERED that the petition for investigation and certification of rep- resentatives of employees of Rock River Woolen Mills, Janesville, Wisconsin , filed by Textile Workers Union of America , affiliated with Congress of Industrial Organizations, be, and it hereby is, dismissed.
