R-1689 and R-1690, respectively SECOND SUPPLEMENTAL DECISION AND CERTIFICATION,OF:REPRESENTATIVES •Jvf, 27, 1940 On April 8, 1940, the National Labor Relations Board, herein 'called the Board,' issued a Decision, Direction of Elections, and Certification of Representatives in the above-entitled proceedings' and, on May 28 1940, a Supplemental Decision and Direction of Run-off Election.2 Pursuant to the Direction of Run-off Election an election by secret ballot was conducted on June 7, 1940, under the direction and super- vision of the Regional Director for the Eleventh Region (Indianapo- lis, Indiana), among employees of Reeves Pulley Company, Columbus, Indiana, herein called the Company, said employees being described in the Decision, Direction of Elections, and Certification of Represen- tatives as "Group (a)." On June 10, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued- and duly served upon the parties his Election Report upon the said election. No objections to the conduct of the ballot in said election or the said Election Report have been filed by any of the parties. . . In his said Election Report the Regional Director reported the following results on the balloting : 'Total Number of Employees Alleged Eligible to, Vote-_______ 120 Total Number Voted_______________________________________ 115 Total Number of Valid Votes Cast___________________________ 112 1 22 N. In the Supplemental Decision and Direction of Run-off Election we postponed our determination of the appropriate unit or units for col- lective bargaining pending the results of, the run-off election directed, and in that connection stated: "... if the I. A. M. [Columbus Local Lodge No. 1466, International Ass6eiation of Machinists, herein called the I. A. M.] wins this election, we shall 'certify the I. A. M. as the ,exclusive representative of employees in Group (a) and the Inde- pendent [Transmission Workers and Machinists Union 'of Columbus, Indiana, herein called the Independent] as the exclusive representative of employees in Group (b)." The reference to "Group (b)" was to certain employees of the Company so described in the Decision,, Direc- tion of Elections, and Certification of Representatives. The results of the run-off election show that the I. A. M. has been selected by a majority of the employees in Group (a) as their repre-- sentative for the purposes of collective bargaining and, accordingly, we shall find that such. employees constitute an appropriate unit for collective bargaining, and we shall certify the I. A. M. as the exclusive representative of employees in such unit for the purposes of collective bargaining. Further, in accordance with what we stated in the Sup; plemental Decision and Direction. of Run-off Election, we shall And that the employees in Group (b) constitute an appropriate unit for collective bargaining, and we shall certify the Independent as the exclusive representative of employees in such unit for the purposes of collective bargaining. Accordingly, upon the entire record in the case, the Board makes the following: SUPPLEMENTAL FINDINGS OF FACT We find that all tool makers, machinists and specialists, their ap- prentices and helpers, of the Company, employed in departments A, B, C, D, E, F, G, M, and P, under the pay-roll classifications set forth in Appendix A,, including William Ott, but excluding employees in the pattern-makers department, supervisory and clerical- employees, con- fidential employees, time-study men, and persons having the right to hire or discharge employees, constitute a unit appropriate for the purr 1020 DECISIONS OF NATIONAL LABOR RELATIONS BOARD poses of collective bargaining and that said. unit will insure to em- ployees of the Company the full benefit of their right to self-organiza- tion and to collective bargaining and otherwise will effectuate the policies of the Act. We further find that all employees of the' Company, excluding tool makers, machinists and specialists, 'their apprentices and helpers, employed in departments A, B, C, D, E, F, G, M, and P, under the pay- roll classifications set forth in Appendix A, and William Ott, and also excluding employees in the pattern-makers department, supervisory and clerical employees, confidential employees, time-study men, and persons having the right to hire or discharge employees, constitute a unit appropriate for the purposes of collective bargaining and that said unit will insure to employees of the Company the full benefit of their right to self-organization and to collective bargaining and other- wise will effectuate the policies of the Act Upon the basis of the above findings of fact and upon the. entire record in the case, the Board makes the following : SUPPLEMENTAL CONCLUSIONS OF LAW 1. All tool makers, machinists and specialists, their apprentices and. helpers, of the Company, employed in. departments A, B, C, D, E, F, G, M, and P, tinder the pay-roll classifications set 'forth in Appendix A, including William Ott, but excluding employees in the pattern-makers department,. supervisory and clerical employees, confidential' em- ployees, time-study men, and persons having the right to hire or dis- charge employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of 'Section 9 (b) of, the National Labor Relations Act. 2. All employees of the Company, excluding tool makers, machinists and specialists, their apprentices and helpers, employed in depart- ments A, B, C, D, E, F, G, M, and P, under the pay-roll classifications 'set forth in Appendix A, and William Ott, and also excluding em- ployees in the pattern-makers department, supervisory and clerical employees, confidential employees, time-study men, and persons having the right, to hire or discharge employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the National Labor Relations Act. CERTIFICATION OF( REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations - Series 2, as amended, REEVES PULLEY COMPANY 1021 IT IS HEREBY CERTIFIED that Columbus Local Lodge No. 1466, Inter- national Association of Machinists, affiliated with the American Fed- eration of Labor, has been designated and selected by a majority of all tool makers, machinists and specialists, their apprentices and helpers, of Reeves Pulley Company, Columbus, Indiana, employed in depart- ments A, B, C, D, E, F, G, M, and P, under the pay-roll classifications set forth in Appendix A, including William Ott, but excluding em- ployees in the pattern-makers department, supervisory and clerical employees, confidential employees, time-study men, and persons having the right to hire or discharge employees, as their representative for the purposes of collective bargaining, and that, pursuant'to the provisions of Section 9 (a) of the Act, Columbus Local Lodge No. 1466, Inter- national Association of Machinists, affiliated with the American Feder- ation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
