The Direction of Election provided that an election by secret ballot be conducted within thirty (30) days from the date of the Direction among all the employees of Read Machinery Co., Inc., exclusive of pattern makers, draftsmen, office workers, and supervisory employees, to determine whether or not they desire to be represented by Local Lodge #243 International Association of Ma- chinists, for the purposes of collective bargaining. Pursuant to the Direction, the election by secret ballot was held on December 20, 1939, at York, Pennsylvania, under the direction and supervision of the Regional Director for the Fourth Region. On December 22, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, issued and duly served upon the parties an Election Report containing a tally of the ballots. In his Report the Regional Director certified that the ballot was fairly and impartially conducted, .that the ballots cast were duly and fairly counted under his supervi- sion, and that statements to such effect had been filed with him by the tellers. 1 18 N. B., No. 61. 607 608 DECISIONS OF NATIONAL LABOR RELATIONS BOARD As to the balloting and its results, the Regional Director reported as follows : Total eligible to vote---------------------------------------- 136 Total ballots cast------------------------------------------- 134 Ballots-east for Local Lodge No. 243, International Association of Machinists , affiliated with the American Federation of Labor---------------------------------------------------- 44 Ballots cast against Local Lodge No. 243, International Associa- tion of Machinists , affiliated with the American federation of Labor---------------------------------------------------- 83 Blank ballots----------------------------------------------- 0 Void ballots------------------------------------------------ 0 Challenged ballots------------ ------------------------------ 7 Total------------------------------------------------------- 134 As appears in his Report, the Regional Director made no determina- tion as to whether the challenged ballots should be counted. Assuming that those ballots were cast for Local Lodge #243 International Asso- ciation of Machinists, which challenged them, the outcome of the elec- tion would be unchanged. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees in the appro- priate unit. The petition of Local Lodge #243 International Association of Machinists for investigation and certification of repre- sentatives of employees of Read Machinery Co., Inc. will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY oRDERED that the petition for investigation and certifi- cation of. representatives of employees of Read Machinery Co., Inc., filed by Local Lodge. #243 International Association of Ma- chinists, be, and it hereby is, dismissed.
