AMENDMENT TO DECISION
April 8, 1940
On March 27, 1940, the National Labor Relations Board, herein
called the Board, issued a Decision and Order in the above-entitled
case. The Decision recited a stipulation entered into on February
29, 1940, by Providence Coal Mining Company, Providence, Webster
County, Kentucky, United Mine Workers of America, District #23,
affiliated with the Congress of Industrial Organizations, and counsel
for the Board. In the fourth line of paragraph X of said stipula-
tion, reference is made to paragraph "IX" thereof. The following
supplemental stipulation has been filed with the Board:
It is hereby stipulated, consented to and agreed, by and be-
tween Providence Coal Mining Company by A. L. Donan its
General Manager ; United Mine Workers of America, District
#23, affiliated with the Congress of Industrial Organizations by
Ed J. Morgan its president; and Arthur R. Donovan, Regional
Attorney for the Eleventh Region of the National Labor Rela-
tions Board as follows :
1. That in the fourth line of paragraph X in the stipulation
dated February 29, 1940, the figure "IX" now appears and it is
agreed that said stipulation should be deemed amended so as to
change the figure "IX" to the figure "VIII," and
It is further stipulated and agreed that this stipulation be
made a part of the record in the above proceeding.
The supplemental stipulation is hereby approved and made a part
of the record in the case.
The Board hereby amends the Decision of March 27, 1940, by
striking the figure "IX" appearing in the fourth line of paragraph
X in the stipulation recited therein, and substituting therefor the
figure "VIII."
