Case No. R-1861 SUPPLEMENTAL DECISION AND ORDER August ,23, ,1940 On June 27, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.1 Pursuant to the Direction of Election, an election by secret ballot was conducted on July 9, 1940 under the direction and supervision of the Regional Director for the Third Region (Buffalo, New York). On July 10, 1940, the Regional Director, acting pursuant to Article 1II, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. As to the balloting and its results, the Regional Director reported. as follows: Total on eligibility list------------------------------------ 98 Total ballots cast---------------------------------------- 94 Total valid ballots cast----------------------------------- 93 Ballots in favor of National Association of Die Casting Workers, Local #4, C. 1. 0-------------------------------------- 32 Ballots in favor of Precision Employees Independent Union--- 1 Ballots in favor of neither-------------------------------- 60 Challenged ballots--------------------------------------- 1 Void ballots---------- - --------------------------------- 0 Blank ballots------------------------------------------- 0 On July 15, 1940, National Association of Die Casting Workers, Local #4, C. I. 0., herein called the Die Casting Workers, filed with the Regional Director Objections to the Election Report. On August 16, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued a report on Objections to the Election Report. 1 24 N. B., No. 108. 1053 1054 DECISIONS OF NATIONAL LABOR RELATIONS BOARD We have considered the objections of the Die Casting Workers, and the Regional Director's Report thereon and we are of the opinion that the objections raise no substantial and material issues with respect to the conduct of the election. The objections are hereby overruled. The results of the election show that no collective bargaining representative has been selected by a majority of the employees within an appropriate unit. The petition of the Die Casting Workers, for investigation and certification of representatives of employees of Precision Castings. Company, Inc., will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Precision Castings Com- pany., Inc., Syracuse, New York, filed by National Association of Die Casting Workers, Local #4, C. 1. 0., be, and it hereby is, dismissed.
