MISCIMARRA, MEMBER LAUREN McFERRAN, MEMBER Dated, Washington, D.C., October 20, 2016 1 This case involves the Board’s final rule on representation case procedures, with which Member Miscimarra disagrees for the reasons expressed in his dissenting views to the final rule. 79 Fed. Reg. 74308, at 74430-74460 (Dec. 15, 2014) (dissenting views of Members Miscimarra and Johnson). In the instant case, however, the parties stipulated to the election, and the Employer objects to the final rule generally (for many reasons similar to those expressed in the dissenting views referenced above), but without identifying particular facts regarding the effect and application of the rule in this particular case that warrant review. Moreover, the Board lacks three members who favor reconsideration of the rule. In these circumstances, Member Miscimarra concurs with the denial of the Employer’s Request for Review.
