Case No. R-1584 SUPPLEMENTAL DECISION AND ORDER January 11, 1940 On November 6, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election 1 in the above-entitled case. Pursuant to the Direction of Election, an elec- tion by secret ballot was conducted on November 21, 1939, under the direction and supervision of the Regional Director for the Eighth Region (Cleveland, Ohio). On November 22, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties an Election Report. On November 27, 1939, the United filed Objections to the conduct of the ballot and to the Election Report. On January 4, 1940, the United withdrew its Objections. As to the balloting and its results, the Regional Director reported as follows : Total number of employees eligible-------------------------- 57 Total number of ballots cast--------------------------------- 57 Total number of votes for United Dock Workers Local Indus- trial Union #982 (C: I. 0.) ------------------------------- 25 Total number of votes against United Dock Workers Local In- dustrial Union #982 (C. I. 0.) ----------------------------- 32 Total number of blank ballots------------------------------- 0 Total number of void ballots-------------------------------- 0 Total number of challenged ballots determined eligible (in- cluded in valid votes cast) -------------------------------- 2 The results of the election show that no collective bargaining rep- resentative has been selected by a. majority of the employees in the appropriate unit. The petition for investigation and certification of representatives of employees of Pennsylvania & Lake Erie Dock Co., Conneaut, Ohio, will therefore be dismissed. 3 17 N. L. R. B. 372. 19 N. L. R. B., No. 34. 311 312 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY ORDERED that the petition for investigation and certi- fication of representatives of Pennsylvania & Lake Erie Dock Co., Conneaut, Ohio, filed by United Dock Workers Local Industrial.
