The Respondents’ Motion to Dismiss Complaints is denied. The Respondents
have not demonstrated that the consolidated complaints fail to state a claim upon which
relief can be granted. Further, to the extent that the Respondents’ motion can be
viewed as seeking summary judgment, the Respondents have failed to establish that
there are no genuine issues of material fact warranting a hearing and that they are
entitled to judgment as a matter of law.
